All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of the provision of the Company’s stated services, in accordance with and subject to, prevailing law of the United Kingdom. Any use of the above terminology or other words in the singular, plural, capitalization, and/or he/she or they, are taken as interchangeable and therefore as referring to same.

By placing an order on the website you accept all the terms laid out in our terms and conditions and confirm you are at least 18 years of age as well entering into a legally binding contract with us.

Payments

We currently accept the following methods of payment: Visa Debit, Visa Credit, Mastercard Debit, American Express, Maestro, Mastercard Credit, and Bank Transfer as well as Cash (Pound Sterling).

All payment is taken in British Pound Sterling. If we ever quote prices in a foreign currency please note that this is merely for guidance to give an indication of the cost as currencies fluctuate due to exchange rates.

 

 

Pricing

All prices on our website quoted are inclusive of VAT. The only possible additional charge above the price quoted for the item is a carriage charge.

The VAT will be clearly marked for each item on the invoice with every order.

Our site contains many products, and it is always possible that some of the products listed on our site may be incorrectly priced. This could be due to several reasons, including and not restricted to human error, software glitches, and more.

We verify prices as part of our dispatch process so that, where a items’ correct price is less than our stated price, we will charge the lower amount when dispatching the item to you.

If an item’s correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before dispatching the item, or reject the order and notify you of this. We are under NO obligation to provide the Product to you at the incorrect (lower) price, even after we have sent you a Dispatch Confirmation if the pricing error is obvious and unmistakable and could have reasonably been recognized by you as a mispricing.

Our online prices and store prices can vary and offers and deals may be exclusive to either the website or store, which are NOT interchangeable.

 

Stock Availability

We do our best to stock the widest range of tools and always have them ready to ship or collect. However, we may experience delays due to a variety of reasons including but not restricted to excess demand, manufacturer delays, weather-related and more. In which case we will contact you directly to explore all options such as offering an alternative product. We will only supply an alternative product once we have written permission (eg email). If you choose not to respond or accept an alternative we will refund the amount and any shipping charges involved. The refund would only be for the items we are unable to supply and NOT the entire order.

 

 

Pre-order Items

Some items that are listed on our website are pre-orders, which means you are pre-purchasing an item before it is officially released. The date for these items can often vary from the original date initially scheduled, we will endeavor to keep you updated about this along the way. However, we would like to stress that we have no control over these dates and they can change without prior warning. You can of course opt-out and have the value of your order refunded but we would like to ask you to carefully consider this decision as the price can change upon general release as well stock being extremely limited.

 

 

Special Order/Back Order Items

Some items on our website are special orders/Back-ordered, this means we would need to order this item specifically for you. This could be due to a number of reasons high value, bulky item, rare item, and so on. Unfortunately, we are unable to offer a refund on these.

 

Returns and Refunds

Currently, we cannot offer returns and refunds on the following items:

All Clothing, Footwear, and Apparel Accessories – For hygiene reasons

Batteries – Only FLEXVOLT batteries cannot be returned as they contain a special seal if removed or broken

Special Order/Back order Items – Any item we have specifically order in for you, which we don’t normally stock, if you are unsure please ask us.

 Please note all refunds will be made in GBP and we are NOT responsible for any changes in exchange rates, which means that you may receive more or less than originally paid in your local currency.

Faulty, Incorrectly Supplied, and Damaged Items

Upon receiving your order, we would highly recommend checking everything to ensure you have received the correct items as per the invoice, as well as the items being received in a suitable condition. If you receive an order that has incorrect, damaged, or faulty items please contact us within 48 hours using the contact form on the website. We would highly recommend taking clear photos of the package and items to help us resolve the issue correctly.

If any items are faulty within 30 days of purchase we will endeavor to resolve them by taking the appropriate actions if this includes replacing them or repairing them free of charge (subject to assessment by us).

 

Lost Packages/Damages

If your package is lost or damaged in transit, we will endeavor to raise a claim with the courier on your behalf, this can take some time (depending on the courier) so please bear in mind we are unable to offer compensation or replacements till the investigation is fully completed.

 

Import Duty

Any items ordered from outside of the UK may be subject to import duties and taxes which are levied when you receive the item or just before delivery is made. This is something we are unable to estimate or pay on your behalf and do not have any control over. We would highly recommend checking with your state or local customs office before ordering.

If you do order something and refuse to pay the charges and should the item get returned to us We will only be able to offer a partial refund on the items ordered only, not the shipping costs. In addition, you will also be charged a 25% restocking & admin fee.

 

 

Force Majeure – Events outside our control

We will not be held responsible or liable for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control ‘Force Majeure’ Event.

A Force Majeure Event includes any act, event, non-happening, omission, or accident beyond our reasonable control and includes in particular and not limited to the following:

Strikes, lock-outs, or other industrial action

Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not), or threat or preparation for war

Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or other natural disasters

Impossibility of the use of railways, shipping, aircraft, motor transport, or other means of public or private transport.

Impossibility of the use of public or private telecommunications networks.

The acts, decrees, legislation, regulations, or restrictions of any government.

Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavors to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.

 

Warranty

As we sell many of the latest tools imported from around the world. Tool manufacturers often region lock the warranties. Meaning we are unable to offer an extended warranty beyond 30 days unless otherwise stated. Please refer to individual products as well as our warranty page.

All tools which cannot be registered for an extended warranty will be clearly marked as “imported” please ensure you check this before making a purchase. All imported tools come directly from the manufacturer and are brand new. We highly recommend getting all tools insured to keep them protected from theft and any potential issues.

Any power tools originating from the UK and designed for the UK market will come with an extended warranty as per manufacturer terms and conditions (see our warranty page). However, this can only be activated by registering the tool within 30 days of purchase. Outside of this time period, it is at the discretion of the manufacturer. We will not be held liable for failure to register your tool in time.

 

Our Liability

1) We warrant to you that any item purchased from us through our site is of satisfactory quality and reasonably fit for all the purposes for which products of the kind are commonly supplied.

2) Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the item you purchased and any losses which are a foreseeable consequence of us breaking the agreement. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us.

3) This does not include or limit in any way our liability:

a) For death or personal injury caused by our negligence;

b) Under section 2(3) of the Consumer Protection Act 1987;

c) For fraud or fraudulent misrepresentation; or

d) For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability,

4) We are not responsible for indirect losses which happen as a side effect of the main loss or damage and which are not foreseeable by you and us, including but not limited to:

a) loss of income or revenue

b) loss of business

c) loss of profits or contracts

d) loss of anticipated savings

e) loss of data, or

f) waste of management or office time however arising and whether caused by tort (including negligence), breach of contract or otherwise even if foreseeable];

provided that this clause 4 shall not prevent claims for loss of or damage to your tangible property that fall within the terms of clause 1 or clause 2 or any other claims for direct financial loss that are not excluded by any of categories (a) to (f) inclusive of this clause 4.

 

Delivery

Once items are delivered to your doorstep, they will be at your own risk. We would highly recommend adding additional delivery instructions to ensure they are delivered safely. If you are unable to receive your package(s) for any reason please inform the carrier well in advance as they will normally attempt to deliver three times before the package is returned to us. We will be happy to resend the item(s) at additional cost (to you) once we have received written consent.
